the problem with fair use is that it's court determined. for lawrence lessig, all it is is "the right to an attorney".
if you're a small business, or an individual, the last thing you want is the hassle of litigation, so given a similar takedown order from a big media company, you'll just fold.
so what happens is a de facto erosion of fair use and, correlatively, free speech.
good thing they have an EFF in the US.
i'm wondering if there is a similar organization here that can take up the cudgels for fair use and user's rights...
