Cybercrime Act now!(before it becomes obsolete)

America eagerly awaits the announcement of President Obama regarding the creation of the position of cyber czar (person to coordinate the US efforts to protect government and private computer systems from hackers, criminal gangs, terrorists and spies) after reports that there were cyber attacks on government and commercial websites on July Fourth. These attacks were traced to China, Russia and North Korea. While I don’t suppose KJI would be interested in launching a cyber attack on our government’s website anytime soon we nevertheless need to take measures against cyber threats which could include activities such as espionage, hacking, identity theft, crime, and terrorism.
Our cybercrime bill has been sleeping (though not archived) in congress for five years now, while cybercrimes go unpunished in this jurisdiction. In 2007 Mark Verzo, the alleged operator of controversial Internet porn site boybastos.com was arrested by NBI but was also freed without being charged(nullum crimen, nulla poene sine lege).
Our Cyber laws are mostly reactive; the E-commerce act was enacted after the I Love You virus. Now the Cybercrime Bill might become law after the hype on the Katrina Halili/Hayden Kho scandal. The cyber world is ever changing, new computers and gadgets are launched everyday, new applications are developed by the hour in this day and age aside from change one thing is also constant, abuse. There’s no reason to sit and wait till it happens, action should be taken now.
