Everybody knows Michael Jordan─the best basketball player in my book. I stopped watching NBA the day he retired. I'm looking forward to his induction to the Naismith Memorial Basketball Hall of Fame this fall! I’ve likewise been looking forward to the commemorative products to be realized in line with this grand event not that I’d be able to afford to buy them but it would be exciting to at least see them!
However, it seems that there is a lawsuit against Nike, Inc. and the NMB Hall of Fame by SportsFuzion, Inc. over Jordan’s Hall of Fame Collection which Nike will be releasing. SportsFuzion claims that Nike, Inc and NMB Hall of Fame conspired to eliminate it from “manufacturing, marketing and selling” sportswear related to the much awaited affair when since 2006, it had been the “exclusive worldwide rights to the Hall of Fame’s trade names, logos, trademarks, designs, and photos for use in sportswear.” SportsFuzion said that after negotiations, Nike backed out and wanted to deal directly with NMB Hall of Fame which is a violation of its contract with NMB Hall of Fame. It also claims that as early as 2005 it had already began to plan and created the concept of such product line in preparation for this big event. Nike would be raking in an estimated $ 100 million in profits by selling said products. Fish & Richardson, the largest intellectual property law firm in the world, is representing the complainant. This would be an interesting case, I think, given that I know nothing about IPL. I want to see how NMB Hall of Fame would wriggle out the exclusive licensing agreement they have with SportsFuzion, Inc. and how Nike would be able to defend itself on account of a legitimate business decision (which I think it would’ve come up with by itself sooner or later even if SportsFuzion, Inc. had not given it the idea.) In any case, Jordan will still be the biggest winner- he still gets inducted and he still gets richer (from royalties, I assume) regardless of the result of the lawsuit! :D
