So I was talking about the sneaky folks at Encore Marketing International. Their target customers are retail, catalog and internet merchants. They seem to range from TV informercials, catalog sales, online ads, etc. I think my mom bought something off a catalog. In another case, it was for an ad by a company masquerading as a credible company (e.g. pretending to be Amazon, but they’re not). In another, for a free gas card. Some people recieved their orders, most didn’t. Numerous complaints have been filed with the Federal Trade Commission and the State Attorney Generals Office in the United States against EMI, but all my googling seems to indicate that no prosecution has been initiated.
Anyway, my dad disputed the unauthorized charges but the bank would only refund the last 3 months. What’s our remedy? Does the bank owe us due diligence, should they know about recognized credit card scams? Presuming we purchased something online while in the Philippines, would we have a cause of action in Philippine Courts against Encore? Can we sue the company availing of Encore’s services? If we bought from the fake Amazon, could we sue the real Amazon? Bottom-line: Buy from reputable sources.
